The Citizenship quandary was created by the BJP in 2004, when they brought in the Citizenship (Amendment) Act, 2003 (officially labeled Act 6 of 2004). Introduced by L.K. Advani, who was the Union Home Minister and Deputy Prime Minister at the time.

The 2003/2004 law completely shifted the legal landscape in massive ways:

Previously, if you were born in India and at least one parent was an Indian citizen, you were a citizen. The 2004 law added a strict caveat: you only get citizenship by birth if one parent is a citizen AND the other is not an illegal migrant.

The law explicitly disqualifies a child if one parent is an illegal migrant, the child does not automatically inherit the citizenship of their legal Indian parent.

The restriction doesn't just apply to birth. Under Section 5 (Citizenship by Registration) and Section 6 (Citizenship by Naturalization), the law explicitly states that "illegal migrants" cannot utilize these pathways. Because the child's status is legally compromised by the parent's illegal status, they are trapped in a legal limbo, often rendering the child effectively stateless within India despite having a legal Indian parent.

This 2003 amendment also inserted Section 14A into the Citizenship Act, which authorized the government to compulsorily register every citizen and issue National Identity Cards—laying the legal groundwork for the National Register of Citizens (NRC).

All of us are now demanding to know "WHAT IS THAT SINGLE CITIZENSHIP DOCUMENTARY PROOF?"

BJP Govt will now say, you asked for it, we will do NRC and issue you "CITIZENSHIP CARD/National Identity Card" after NRC.
